USCIS Clarifies the Starting Point for NIW Eligibility

2025-01-15

Updated guidance addresses underlying EB-2 eligibility and the relationship between an applicant's qualifications and proposed endeavor.

USCIS issued policy guidance on January 15, 2025 addressing EB-2 petitions that request a National Interest Waiver. The update emphasizes that an applicant must establish eligibility for the underlying EB-2 classification before USCIS evaluates whether the job-offer and labor-certification requirements should be waived.

This distinction matters for both advanced-degree professionals and applicants relying on exceptional ability. An NIW petition cannot begin and end with an argument that the proposed work is important. The record must also establish the relevant threshold qualifications and address their relationship to the endeavor described in the petition.

The waiver itself remains a separate analysis. Applicants must explain the endeavor's substantial merit and national importance, show that they are well positioned to advance it, and establish why a waiver would benefit the United States on balance. General statements about an industry should not substitute for evidence about the specific proposed work.

A practical preparation step is to organize the record into distinct questions: the applicant's qualifying background, the proposed activity, the evidence of prospective impact, and the support for carrying out the plan. This makes gaps easier to identify before drafting the legal argument.

The policy update does not mean that a particular degree or profession automatically qualifies for a waiver. Elementa Law assesses the individual record and the proposed endeavor together, using the requirements applicable when the petition is prepared and filed.
